• Be an Indian resident unless otherwise permitted

Individuals declared incompetent to contract, including minors and undischarged insolvents, are prohibited from using the Platform.

KapitaLoan reserves the right to suspend or terminate any account found to be in violation of these eligibility requirements.

4. Registration & Account

By using the Platform, you consent to receive communications electronically, including but not limited to:

• Push Notifications

• Verification
• Account Activity
• Offers & Promotions
• Repayment Reminders
• Legal Notices
• Regulatory Updates

Electronic communications shall satisfy any legal requirement for written communication.

6. Transaction & Communication Platform

KapitaLoan operates as a technology platform that enables users to apply for personal loans offered by regulated financial institutions, including NBFCs and other lending partners. KapitaLoan facilitates the digital loan application process but is not a lender unless expressly stated.

6.1 Role of KapitaLoan

KapitaLoan acts solely as a technology and service platform that connects eligible users with lending partners. The final approval, sanction, disbursement, interest rates, loan amount, repayment schedule, and other lending terms are determined exclusively by the respective lending partner.

KapitaLoan does not guarantee loan approval, disbursement, or eligibility for any loan product.

6.2 Loan Application

By submitting a loan application through the Platform, you authorize KapitaLoan and its lending partners to:

• Verify your identity and eligibility.
• Process your application.
• Access and validate information submitted by you.
• Share your application with eligible lending partners.
• Contact you regarding your loan application.

Submission of an application does not guarantee approval or disbursement.

6.3 KYC & Verification

You agree to provide all documents and information required for Know Your Customer (KYC) verification and loan processing, including but not limited to:

• PAN Card
• Aadhaar Card
• Address Proof
• Income Proof
• Employment Details
• Bank Statements
• Selfie or Live Verification
• Other documents requested by the lending partner

Providing false or misleading information may result in rejection of your application or termination of your account.

6.4 Credit Bureau Authorization

By using the Platform, you expressly authorize KapitaLoan and its lending partners to obtain your credit information from registered Credit Information Companies (CICs), including but not limited to CIBIL, Experian, Equifax, and CRIF High Mark, for the purpose of evaluating your loan application.

Such authorization shall remain valid until withdrawn where permitted under applicable law.

6.5 Data Verification

You authorize KapitaLoan to verify information provided by you through government databases, financial institutions, employers, service providers, and other authorized third-party verification agencies wherever legally permitted.

6.6 Loan Approval & Disbursement

Loan approval is entirely at the discretion of the lending partner.

KapitaLoan shall not be responsible for:

• Rejection of any application
• Delays in approval
• Changes in interest rates
• Reduction in sanctioned amount
• Cancellation of loan offers
• Delays in fund disbursement

All decisions made by the lending partner shall be final.

6.7 Repayment

Borrowers are solely responsible for repaying all dues, including principal, interest, applicable charges, penalties, and taxes, in accordance with the repayment schedule provided by the lending partner.

Failure to repay may affect your credit score and may result in recovery proceedings as permitted under applicable law.

6.8 User Responsibilities

You agree to:

• Provide accurate information.
• Maintain updated contact details.
• Cooperate during verification.
• Keep your login credentials secure.
• Use the Platform only for lawful purposes.
• Promptly notify KapitaLoan of any unauthorized account activity.

6.9 Third-Party Services

The Platform may integrate with third-party services including payment gateways, credit bureaus, Aadhaar authentication providers, video KYC providers, analytics providers, and communication services.

KapitaLoan is not responsible for interruptions, errors, or failures caused by such third-party services.

6.10 Platform Availability

While KapitaLoan strives to provide uninterrupted access to the Platform, we do not guarantee that the Platform will always be available, error-free, or free from technical interruptions.

Scheduled maintenance, upgrades, or unforeseen technical issues may temporarily affect service availability.

7. Indemnity & Disclaimer of Warranty

7.1 Indemnity

You agree to indemnify, defend, and hold harmless KapitaLoan, its affiliates, directors, officers, employees, partners, licensors, and service providers from and against any claims, liabilities, losses, damages, penalties, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Misuse of the Platform.
• Submission of false or misleading information.
• Violation of applicable laws.
• Infringement of any third-party rights.
• Breach of your obligations under these Terms.

7.2 Disclaimer of Warranty

The Platform and all related services are provided on an "as is" and "as available" basis.

KapitaLoan makes no warranties, express or implied, including but not limited to warranties regarding:

• Availability of the Platform.
• Accuracy of information.
• Loan approval.
• Loan amount eligibility.
• Interest rates.
• Processing timelines.
• Error-free operation.
• Security against all cyber threats.

Your use of the Platform is entirely at your own risk.

7.3 No Guarantee

KapitaLoan does not guarantee:

• Approval of any loan application.
• Lowest interest rates.
• Fastest disbursal.
• Loan offers from any specific lender.
• Continuous availability of the Platform.

All lending decisions remain solely with the respective lending partner.

8. Intellectual Property Rights

8.1 Ownership

All content, materials, software, designs, graphics, logos, trademarks, icons, text, images, videos, user interfaces, source code, and other intellectual property available on the Platform are owned by or licensed to KapitaLoan and are protected under applicable copyright, trademark, and intellectual property laws.

Nothing contained on the Platform grants you any ownership rights or licenses to use our intellectual property except as expressly permitted in these Terms.

8.2 Permitted Use

You may access and use the Platform solely for your personal, lawful, and non-commercial use in connection with applying for or managing financial products and services.

8.3 Restrictions

Without prior written consent from KapitaLoan, you shall not:

• Modify, adapt, translate, or create derivative works.

Unauthorized use may result in civil and criminal liability under applicable laws.

9. Intellectual Property & Trademark Complaints

• Loan rejection or cancellation.
• Delays in loan approval or disbursement.

• Technical failures.
• Unauthorized access to your account caused by your negligence.
• Loss of data or business opportunities.
• Third-party services integrated with the Platform.
• Malware, viruses, or other technological issues beyond our reasonable control.

KapitaLoan's maximum liability, if any, shall not exceed the amount of service fees actually paid by you to KapitaLoan for the specific transaction giving rise to the claim, where permitted by applicable law.

• Availability of every financial product.
• Specific loan amounts.
• Fixed interest rates.
• Processing timelines.
• Continuous Platform availability.

Loan approval depends entirely upon the lending partner's internal policies, verification processes, eligibility criteria, risk assessment, and applicable regulations.

KapitaLoan is solely a technology platform facilitating loan applications and does not itself guarantee the sanction or disbursement of loans unless explicitly stated.

Users are responsible for reviewing all loan terms, repayment schedules, charges, and disclosures before accepting any loan offer.

KapitaLoan shall not be responsible for any financial loss arising from:

• Rejection of a loan application.
• Incorrect information provided by the user.
• Decisions made by lending partners.
• User's failure to repay loans.
• Misuse of account credentials.

14. Governing Law & Jurisdiction

Users accessing the Platform from outside India do so at their own discretion and are solely responsible for complying with the applicable laws of their respective jurisdictions.

Providing false, misleading, or fraudulent information may result in immediate suspension or termination of your account and may be reported to the appropriate authorities where required by law.

• Remove or restrict access to any content that violates applicable laws or these Terms.

16.6 Third-Party Lending Partners

KapitaLoan partners with regulated financial institutions, including Non-Banking Financial Companies (NBFCs) and other lending partners, to facilitate loan applications.

Loan approval, sanction, disbursement, interest rates, repayment schedules, and all lending decisions are made solely by the respective lending partner based on its internal policies and applicable regulations.

KapitaLoan does not influence or guarantee any lending decision.

16.7 Account Suspension or Termination

KapitaLoan reserves the right to suspend, restrict, or permanently terminate your access to the Platform without prior notice if:

• You violate these Terms.
• You engage in fraudulent or illegal activities.
• You provide false or misleading information.
• Your use of the Platform poses a security or operational risk.
• Such action is required under applicable law or regulatory direction.

Termination of your account does not relieve you of any outstanding repayment obligations or other legal responsibilities arising prior to termination.
